I. Overview

This website is operated by ARES CUE. Throughout the site, the terms “we,” “us,” and “our” refer to ARES CUE. ARES CUE offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

 

By accessing or using any part of the site, you agree to be bound by these Terms of Service.

 

II. E-commerce Terms

  1. Acceptance: By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority and you have given us your consent to allow any of your minor dependents to use this site.

  2. Product Information and Customization:

    • We have made every effort to display the colors and images of our products accurately. We cannot guarantee that your device's display of any color will be accurate.

    • Custom Product Confirmation: After you submit an order, especially for custom cues, it is your responsibility to carefully review and confirm the accuracy of all customization details (including specifications, engraving, colors, etc.) before the final production begins. Once production has started, the order is considered final, and any request for changes or cancellation may be denied or incur additional fees.

  3. Prohibited Uses: You may not use our products for any illegal or unauthorized purpose.

III. Orders, Pricing, and Payment

  1. Order Acceptance: Your submission of an order does not constitute our acceptance of that order. We reserve the right to refuse any order for any reason at any time. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order.

  2. Pricing: Prices for our products are subject to change without notice.

  3. Payment: You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You authorize us to charge your payment provider for any purchases.

  4. Order Cancellation (Custom Products): Orders for custom billiard cues, once they have entered the customization process (i.e., after your payment is completed and production has begun), are generally non-cancellable. Should you insist on cancellation, we reserve the right to deduct a customization fee of up to 50% from the Store Credit refund, based on incurred material and labor costs.

IV. Returns, Refunds, and Shipping

  1. Policy Reference: All terms and conditions regarding returns, exchanges, refunds, and shipping are governed by our Refund Policy and Shipping Policy.

  2. Refund Method (Custom Products): You agree that, according to our Refund Policy, all eligible refunds will be issued in the form of Store Credit, and we do not provide cash or refunds to the original payment method.

V. Intellectual Property

  1. Site Content: The Site and its original content (including text, graphics, logos, images, cue designs) are the property of ARES CUE and are protected by copyright, trademark, and other intellectual property laws. You may not use or reproduce any content from the Site without our prior written permission.

  2. Customer Custom Designs: You warrant that the use of any design, engraving, or trademark provided by you for customization will not infringe upon the intellectual property rights of any third party. You agree to indemnify ARES CUE against any claims or losses arising from the designs provided by you.

VI. Disclaimer of Warranties; Limitation of Liability

  1. Disclaimer: We do not guarantee that your use of our service will be uninterrupted, timely, secure, or error-free. You expressly agree that your use of, or inability to use, the service is at your sole risk.

  2. Limitation of Liability: In no case shall ARES CUE, our directors, employees, affiliates, agents, contractors, suppliers, or service providers be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind (including, without limitation, lost profits, lost revenue, lost data, replacement costs, or any similar damages).

  3. Product Disclaimer: All billiard cues are provided “as is” and “as available” without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

VII. Indemnification

You agree to indemnify, defend, and hold harmless ARES CUE and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third party.

 

VIII. Termination

We may terminate or suspend your access to the Site immediately, without prior notice or liability, if we determine, in our sole discretion, that you have breached these Terms of Service. All provisions of these Terms which by their nature should survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability, shall survive termination.

IX. Governing Law and Dispute Resolution

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the Laws of the People's Republic of China.
